Submission of an application constitutes acceptance of the following Terms and Conditions.

1. Assumption of Risk
Participation in and attendance at the NorCal Celtic Festival involves inherent risks that cannot be eliminated regardless of the care taken to avoid injuries or damages.
Such risks may include, but are not limited to:
• Large crowds and public gatherings
• Weather conditions, including wind, rain, and heat
• Uneven surfaces and temporary structures
• Equipment and vendor operations
• Food and beverage consumption
• Alcohol service
• Animals or livestock
• Traffic and parking conditions
By participating in the event, the Participant knowingly and voluntarily assumes all risks of injury, illness, property damage, loss, or death arising out of or related to participation in the event.

2. Release of Liability
To the fullest extent permitted by California law, Participant releases, waives, and discharges the NorCal Celtic Festival, Visit Woodland, Woodland Hoteliers Group, the Yolo County Fairgrounds, Yolo County, and each of their respective officers, directors, employees, agents, volunteers, contractors, sponsors, and representatives (collectively referred to as the “Released Parties”) from any and all liability, claims, demands, causes of action, damages, or expenses arising from participation in the event.
This release includes claims arising from the active or passive negligence of the Released Parties to the fullest extent permitted by law.

3. Indemnification and Defense
Participant agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, liabilities, losses, costs, or expenses, including reasonable attorney’s fees, arising out of or related to:
• Participant’s presence at the event
• Participant’s booth, equipment, or property
• The actions or omissions of Participant or their employees, volunteers, or representatives
• The sale, distribution, or promotion of goods or services
This indemnification obligation shall survive the completion of the event.

4. Compliance With Laws and Permits
Participants agree to comply with all applicable federal, state, county, and local laws, regulations, and ordinances, including but not limited to:
• California Department of Public Health regulations
• Yolo County Environmental Health permits
• California Fire Code requirements
• ADA accessibility requirements
• Sales tax reporting requirements
Food or beverage distribution, sampling, or sales are strictly prohibited without proper permits and approval from event management.

5. Property and Theft
Participants are solely responsible for all property brought onto the event grounds.
The Released Parties are not responsible for loss, theft, or damage to property before, during, or after the event.

6. Weather, Emergencies, and Force Majeure
The NorCal Celtic Festival is a rain-or-shine event.
The Released Parties shall not be responsible for cancellations, delays, or modifications due to circumstances beyond their control, including but not limited to:
• Severe weather
• Natural disasters
• Government orders
• Public health emergencies
• Terrorism or threats of violence
• Venue closures
• Utility outages
Event management reserves the right to modify schedules, locations, or layouts to ensure safety.

7. Vendor Placement and Event Layout
Booth placement and event layout are determined solely by event management.
Placement may be based on:
• Application completion date
• Product category
• Event layout requirements
• Prior participation
Event management reserves the right to relocate booths if necessary for safety or operational purposes.

8. Photography and Media Release
Participant grants permission to the NorCal Celtic Festival and its partners to photograph, record, and use images, video, or audio of Participant, booths, products, or displays for promotional, marketing, or commercial purposes without compensation.

9. Conduct and Removal
Participants must conduct themselves in a professional and respectful manner.
Event management reserves the right to remove any participant who:
• Violates event policies
• Creates unsafe conditions
• Engages in illegal or disruptive behavior
Removal from the event will not result in a refund.

10. California Civil Code §1542 Waiver
Participant expressly waives the provisions of California Civil Code Section 1542, which states:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist…”
Participant acknowledges that unknown claims may exist and voluntarily waives rights under this section.

11. Agreement and Legal Acceptance
By submitting an application or participating in the event, Participant confirms that they:
• Have read and understand these Terms and Conditions
• Agree to comply with all event policies
• Accept that this agreement is legally binding
This agreement applies to Participant and their heirs, assigns, representatives, and agents.
